On May 14, 2025, the National Assembly issued the Organic Reform Law to several laws concerning Age Discrimination in the Labour System.
This law amends the Labour Code (among other regulations such as the Organic Law of the National Public Procurement System and the Organic Education Law), creating Articles 42.2, 42.3, and 42.4.
These articles establish the obligation for all employers to train their workforce on matters that improve the workplace environment and prevent and eradicate discrimination, harassment, and violence based on age. The start and end of such training must be reported to the Ministry of Labour, which may conduct targeted inspections to verify compliance. These training sessions must not be shorter than 10 hours.
Additionally, employers with up to 25 workers must have at least one employee over 40 years old. Employers with more than 25 employees must ensure that at least 1% of their workforce is over 40.
Failure to comply will result in a daily fine of USD 10 to 20 until the employer meets the requirements.
Furthermore, Article 44 of the Labour Code — Prohibitions for Employers — is amended by adding subsections n, ñ, o, p, and q, which include new prohibitions such as age restrictions in job postings or for holding any position, among others.
